Abstract | Since the mid-1970s, with the passage of the Individuals with Disabilities Education Act (IDEA) and Section 504 of the Rehabilitation Act ("Sec. 504"), special education became highly legalized. Although it is universally agreed that the best way to avoid and resolve disputes is through informal communication and cooperation between parents and school officials, litigation and other legal activity for resolving disputes has increased significantly in the past 30+ years. Knowing what the alternative legal mechanisms are under the IDEA and Sec. 504 is useful for many reasons, including as leverage to promote informal resolution. This article describes legal options and procedures that parents and other caregivers can resort to for resolving disputes in special education under the IDEA and Sec. 504. (ERIC). |
