Abstract | For this 16th article in the series reviewing recent court decisions concerning appropriate school psychology practice from both professional and legal perspectives, the topic is the consequences of student concussions under the Individuals with Disabilities Education Act (IDEA) and/or the Rehabilitation Act of 1973 Section 504. More specifically, the focus here is whether a student's concussion established eligibility under the IDEA or Section 504 and the possible consequences in terms of attorneys' fees. In sum, in this case, the costly consequences in the wake of a student's concussion were for the parents. However, avoiding overgeneralization, school psychologists should be careful that the costly consequences in other cases are not for the district.
