| Abstract | This speech outlines factors that have caused courts to take more active roles in resolving educational problems. Among these factors are the increase in the importance of education, an increasing proclivity to resort to courts, efficient mass communication media, and an inability of legislative bodies to provide all of the solutions to problems of the times. Consequently, the courts have been creating new law, rather than simply redressing alleged wrongs. Accompanying this trend are such new plaintiff tactics as (1) press conferences designed to focus attention on the plaintiff's theory of the case, (2) political pressures on school board members to settle out of court, (3) demands for general and punitive damages, (4) expansion of the class action concept, (5) vigorous and uncompromising legal advocacy by legal groups litigating "law reform" issues, and (6) more extensive representation of public school employee organization members.
