Abstract | Today, as a result of court decisions, an increasing number of children and young adults have been legally placed in pubic foster care. Since the Second World War, many changes in legal provisions, regulations and variations of treatment are now recognized. Children and young adults in such care and custody reflect the dissolution of old family and social structures, along with a change in concepts of child rearing. Until a German High Court decision of 1972, public institutions such as prisons, youth facilities and other agencies nullified the rights of such authorities to act and educate on behalf of special public authorization. Since Human Rights provision has to be fully granted to the inmates, it has modified the structures, rules and social conventions of public legal institutions. This decision finally replaced a judicial tradition created in Prussia in 1794. (DIPF/Orig.). |
