AbstractA study sought to explain why unions fail to obtain contracts 25-30 percent of the time, even after winning the right to negotiate contracts in secret ballot elections. Data were collected from union representatives and National Labor Relations Board (NLRB) records pertaining to a sample of 135 Indiana cases and a sample of 140 cases nationwide where unions had won the right to negotiate during 1979-80. Because the national sample exclusively involved unions affiliated with the AFL-CIO, the data were biased in that they reflected the experience of larger unions rather than that of smaller, independent unions and the International Brotherhood of Teamsters. Unions were found to be more likely to obtain contracts under the following conditions: (1) when they were negotiating contracts with firms that had high wages relative to the firm's industry; (2) when they were negotiating contracts with firms in which separate bargaining units were already under contract with the union; (3) when the percentage of workers voting for union representation was higher and the size of the work unit was larger; and (4) when national union representatives were involved in the negotiations. The unions were less likely to obtain contracts in southern states with right-to-work laws, when the national union required national approval of local first-contract agreements, when the National Labor Relations Board had to resolve employer objections and/or challenges to union election victories, when employers refused to bargain, and when there were discriminatory charges and other forms of illegal discrimination against union activists.
